1. The parties
These Terms are entered between AIKKA SAS, registered in France (RCS Paris, SIREN 993 624 816), 39 rue de la Gare de Reuilly, 75012 Paris (the Company) and the legal entity or person identified at sign-up (the Customer). By accessing pharma-geo.com or app.pharma-geo.com, the Customer accepts these Terms.
2. What PharmaGEO is
PharmaGEO is a generative engine optimization service for pharma brands. The Company audits how brands appear in answers from large language models, scores brand visibility on a 6-axis methodology, and delivers reports, dashboards, and action plans. PharmaGEO is not a medical, regulatory, or commercial endorsement. Outputs are decision-support insights, not promotional claims.
3. Account and access
- The Customer creates an account, designates an admin, and is responsible for credentials.
- Multi-factor authentication is mandatory for admin roles.
- The Company may suspend access to investigate a security incident or a material breach of these Terms.
4. Acceptable use
- The Customer will not reverse-engineer, resell, sub-license, or scrape the platform.
- The Customer will not upload personal health data or patient-level data.
- The Customer will use PharmaGEO outputs in line with applicable pharma codes (EFPIA, ABPI, LEEM) and local promotional rules.
- The Customer remains responsible for all MLR review and regulatory compliance of any content derived from PharmaGEO outputs.
5. Fees and billing
- Fees are stated in the order form. Pilot and Growth plans are billed monthly. Enterprise plans are billed annually.
- Payment terms are net 30 from invoice. Late payments accrue interest at the legal rate plus 3 points.
- Fees are exclusive of VAT.
- The Company can revise fees with 60 days notice for the next renewal cycle.
6. Customer data and IP
- The Customer keeps ownership of inputs it provides (brand list, prompts, briefs).
- The Company keeps ownership of the platform, the methodology, the audit data, the index, and all derivatives, including aggregated and anonymized statistics.
- Reports delivered to a Customer are licensed for internal use within the Customer organization, and may be quoted externally with attribution to PharmaGEO.
- Personal data processing is governed by the Privacy Notice and, for enterprise customers, a Data Processing Agreement.
7. Warranties and disclaimers
The Company will deliver the service with professional care and within agreed timeframes. PharmaGEO outputs reflect public AI answers at a moment in time; LLMs change frequently and the Company cannot guarantee specific score movements or business outcomes. The service is provided as is, without implied warranties beyond those required by mandatory law.
8. Liability
To the fullest extent allowed by French law, the Company is liable only for direct damages, capped at the fees paid by the Customer in the 12 months preceding the claim. The Company is not liable for indirect damages, loss of revenue, loss of opportunity, or reputational harm. This cap does not apply to gross negligence or wilful misconduct.
9. Term and termination
- Pilot plans run month to month and can be cancelled with 30 days notice.
- Growth and Enterprise plans run for 12 months and renew tacitly unless cancelled 60 days before renewal.
- Either party can terminate for material breach not cured within 30 days of written notice.
- On termination, the Customer can export reports for 30 days, after which the Company deletes Customer-specific data within 90 days, subject to legal retention.
10. Governing law
These Terms are governed by French law. Any dispute that cannot be resolved amicably will be submitted to the exclusive jurisdiction of the courts of Paris, France.
